The Patient Safety and Quality Improvement Act (PSQIA) is a federal law that was enacted in 2005 to encourage reporting and learning from adverse events and near-misses in healthcare settings. The law establishes a voluntary reporting system for healthcare providers to submit information on patient safety events, known as Patient Safety Work Product (PSWP).
PSWP is a protected legal status that safeguards the confidentiality and privileged status of information related to patient safety events. It is exempt from disclosure under the Freedom of Information Act (FOIA), and cannot be used in civil, criminal, or administrative proceedings except in specific circumstances.
The PSQIA also established the Patient Safety Organization (PSO) program, which is responsible for collecting, analyzing, and sharing patient safety data. PSOs are independent organizations that work with healthcare providers to improve patient safety by analyzing and sharing data on patient safety events.
