Facts: The plaintiffs, Jim Obergefell and John Arthur, were in a committed same-sex relationship for over 20 years. In 2013, Arthur was diagnosed with ALS and the couple wanted to marry. However, Ohio, where they resided, prohibited same-sex marriage. The couple flew to Maryland, where same-sex marriage was legal, and married on the tarmac of the airport. Arthur died three months later, and Obergefell wanted his name listed as the surviving spouse on Arthur’s death certificate. However, Ohio law did not recognize same-sex marriages performed outside the state and prohibited Obergefell from being listed as the surviving spouse.
